Prior to the change in the laws in 2007, I always said don’t blow. Now, most of the time I would say blow but it is case/fact specific. As an example, if you are involved in a personal injury accident or death case refuse everything. The police will apply for a warrant to get your blood so it will not matter. If you have a CDL you should probably blow.

My reasoning now is that if you win the suppression hearing, the BAC score will also be suppressed, so it doesn’t matter what the score is. On the other hand, if you refuse, you lose your license for a minimum of 1 year and are not eligible for a conditional license unless you plead guilty to some 1192 (DWI) offense.
