There are many factors which determine if you are eligible.
I have made a worksheet for my clients so they can determine if they are eligible. The most common reasons why you would not be eligible are:
1) You have a prior DWI, DWAI, DWAI-Drugs or another 1192 violation within 5 years.
2) You have had two prior section 1192 violations.
3) You are suspended for any other reason.
4) You have a learner’s permit or junior driver license.
If you find yourself in this situation you can call our office and make an appointment as we may be able to file a 440 motion to open your case and make you eligible. If you pled or were found guilty and sentenced and it is less than 30 days we could file a notice of appeal and file an appeal.
